Frank Anderson joined us from Northern Virginia to explain how he and PDA co-chair Stephen Spitz met with the Governor on Wednesday and were specifically told that Frank had "too many moving violations" to have his voting rights restored. According to Governor Kaine, he had restored voting rights for people who only had one or two moving violations. How are simple moving violations related to the ability to vote or a demonstration of good citizenship? No one in the attendee group or the passersby could see the relationship. The Commonwealth of Virginia Web site for voter restoration states that you cannot have any a felony or misdemeanor convictions for two years prior to rights restoration; there is no mention of traffic violations. Herb Townes of Hopewell explained that "until you get your voting rights back, you're not a citizen and you're still locked up." Now that his rights have been restored, Herb is a now a notary and works in Hopewell and Petersburg to help ex-offenders restore their voting rights, get jobs and get back in school.
Salim Khalfani, Executive Director of the Virginia State Conference NAACP and Rev. Dr. J. Rayfield Vines, Jr, President were also speakers. "If we are serious about a democracy, how can we justify a democracy when we deny people the right to vote," was the question asked by Dr. Vines. "We are going to march until we get this thing changed." Linwood Christian of Petersberg also spoke saying, "My plea is to those who can vote, to those who enjoy the right to vote, help us by making it hard for all our politicians that are running for re-election, help us who cannot vote to make a change. Remember as felons, we just got caught; the politicians are looking over their shoulders waiting for the time they will get caught. I say restore our right to vote so we can help you not get caught." When Frank Anderson took the microphone, he explained that those who have read the application know that it says you can't have any felonies or misdemeanors. "You can't do time for a speeding ticket. You can't do time for an improper turn or having the wrong sticker on your car. I haven't been convicted of any misdemeanors since 1998 yet I'm not allowed to vote. We have tried every channel by official means so that's why we are here today. We need to get Governor Kaine's attention and we need to show the people of Virginia that this policy of the Governor's Office is arbitrary and capricious. He can do anything he wants to do, that's why we want the policy changed. We want Governor Kaine to restore the rights of all convicted felons who have completed their sentences. Do you know the State of Vermont let's people vote while they are in prison? What's wrong with giving people their voting rights back. We need to show Governor Kaine that this is a civil rights issue, this is a democracy issue and by the way, he is Chairman of the Democratic National Committee, he should be aware that they have a Voting Rights Institute.
Near the end of the rally, I recognized a young woman from the Sum of Change Video who had been denied by Governor Kaine. She said that she had sent in a new application and she had been hopeful that her rights would be restored. She isn't quite as confident since she, like Frank Anderson, has moving violations.

It was a cold night in Richmond when 25 voter rights activists stood outside Richmond City Hall to ask Governor Tim Kaine to restore the voting rights of the 300,000 disenfranchised Virginia ex-offenders. Supporters included Virginia NAACP leadership, ex-offenders, local media, union members, United Virginia members and Virginia PDA members.
PDA Virginia co-chair, Stephen Spitz explained that on Tuesday the Fairfax County Democratic Committee passed a resolution urging Governor Kaine to restore the vote to all ex-felons who have completed their sentences in the state. That is about 300,000; he has restored about 4,000. For those of you who remember fractions that is a very small percentage. He has the Constitutional duty and responsibility to act and to exercise that authority before January 16th. The phone number is (804) 786-2211. Call his office, his Chief Counsel is Mark Rubin. Ask to speak to Mark Rubin and ask him to sign the Executive Order. If Governor Kaine does not do this, there is a bill in Congress called the Democracy Restoration Act which will restore voting rights to all ex-felons for Federal Elections. I urge you to contact Senators Warner and Webb as well as your Representatives and urge them to support this bill.
